You'll most likely have the need at some time in your life to use a power of attorney. It's unfortunate but a real need that most people will have to use this legal document at the end of their lives to allow someone else they trust to handle their financial matters when they can no longer do this on their own. A normal power of attorney is usually signed by the person who wants their responsibilities handed over to their appointed agent who is usually a friend or trusted relative. The trusted relative or friend signs the form and it is reviewed by an attorney and is notarized to make it a legal document to be used in making sure that all of your business transactions are taken care of the way you want them to be. There are cases however when a legal power of attorney can no longer be signed by you do to an accident, or a disabling illness that makes it impossible for you to sign the normal power of attorney, or you are no longer mentally capable of signing a normal power of attorney form choosing whom you would like to handle your own affairs. In a case like this, a springing power of attorney will be invoked by a court of law to handle all of your business and personal affairs. If at all possible before times like these come about when you incapacitated, it is always better to assign someone as your legal agent ahead of time through a normal power of attorney and by invoking a living will. The springing power of attorney will have to go through the courts and will take some considerable time as it will have to be proven that you are no longer competent to handle your own affairs any longer.
The springing power of attorney takes all decisions away from you, and you will no longer be able to make any decisions on your behalf. If a springing power of attorney is started, chances are you won't realize it has been invoked due to your illness or mental state of mind. Having a good power of attorney and a living will ahead of time will alleviate some of the hardships should you be injured or disabled mentally
